Terms of Use
Article 1 Scope of Application
1. The accommodation agreements and any related agreements entered into between Villa Customa (hereinafter referred to as “the Inn”) and guests shall be governed by these Terms and Conditions. Matters not provided for in these Terms and Conditions shall be governed by applicable laws and regulations or generally established customs.
2. If the inn agrees to a special provision that does not conflict with laws, regulations, or established customs, such special provision shall take precedence over the provisions of the preceding paragraph.
Article 2: Application for Accommodation Contract
1. Guests (meaning the person who has applied for an accommodation contract with this inn or the party that has entered into an accommodation contract with this inn; the same applies hereinafter) must provide this inn with the following information:
(1) Name, address, age, telephone number, gender, occupation, dates of stay, previous accommodation, subsequent accommodation, arrival date and time, and departure date and time.
(2) Any other information deemed necessary by this inn.
2. Please note that the maximum occupancy per room at this inn is 8 guests.
3. If a guest requests to extend their stay beyond the dates specified in Item (1) of the preceding paragraph during their stay, this inn will treat such a request as a new application for an accommodation contract at the time the request is made (the accommodation fee shall be the standard rate set by this inn for the new dates under the applicable plan).
4. We do not accept reservations for guests under the age of 18 (including high school students) unless they have parental permission. A written consent form from a parent or guardian is required for all guests. For elementary and junior high school students, we will accommodate their stay only if they are accompanied by a responsible adult aged 18 or older (other than a family member) and a written consent form from a parent or guardian is submitted.
Article 3: Formation of the Accommodation Contract
1. The accommodation contract shall be deemed to have been formed when the Inn notifies the guest that it has accepted the application referred to in the preceding Article.
2. Even if the guest fails to receive the notification referred to in the preceding paragraph due to the guest’s willful misconduct or negligence, despite the Inn having sent such notification, the accommodation contract shall still be deemed to have been formed.
3. In addition to the provisions of the preceding paragraphs, the Inn may establish special terms regarding the formation of the accommodation contract as deemed appropriate under the circumstances.
Article 4: Refusal of Accommodation Contract and Right of Termination
1. This property reserves the right to refuse to enter into an accommodation contract, or to terminate such contract, in any of the following cases:
(1) When the accommodation request or the accommodation contract violates these Terms and Conditions.
(2) When the guest is unable to receive the notice specified in Article 3, Paragraph 1 for any reason.
(3) When no rooms are available due to full occupancy.
(4) When a guest makes a reservation despite having no intention of staying.
(5) When a guest is a member or associate of an organized crime group as defined in the Act on Prevention of Unjust Acts by Organized Crime Group Members and the Ordinance on the Exclusion of Organized Crime Groups, or of any other antisocial forces.
(6) When it is deemed likely that the guest will engage in conduct contrary to public order or public morals.
(7) When the guest engages in conduct that causes significant disturbance to the inn’s employees, residents, or nearby residents; or when there is a risk that the guest will interfere with the inn’s operations; or when the guest engages in conduct that hinders fire prevention or fire safety measures.
(8) When the guest demands services or other burdens regarding the accommodation that exceed what is reasonably expected under generally accepted social norms.
(9) When a guest is clearly determined to be suffering from a contagious disease, or when a guest is clearly determined to be in poor physical or mental health.
(10) When accommodation cannot be provided due to natural disasters, facility malfunctions, or other unavoidable circumstances.
(11) When, due to the occurrence of a disaster or other emergency, it is actually planned to prioritize the provision of guest rooms for disaster victims and disaster recovery personnel, or when there are grounds equivalent to the preceding item.
(12) When a minor attempts to stay or is staying at the facility without parental consent.
(13) When any other circumstances apply that permit refusal of accommodation as stipulated by various laws, ordinances, or other regulations.
2. If the inn terminates the accommodation contract based on the provisions of the preceding paragraph, no charges will be collected for accommodation services or other services that the guest has not yet received. However, in cases other than those specified in Items 3, 10, and 11 of the preceding paragraph, where the grounds are attributable to the guest, a cancellation fee shall be charged for the accommodation and other services not yet provided (the cancellation fee shall be as set forth in Appendix 2). In such cases, this shall not preclude claims under Article 14.
Article 5: Guest Registration
1. Guests must register the following information on the day of their stay or in advance:
(1) Name, address, age, telephone number, gender, occupation, date of stay, previous accommodation, next accommodation, arrival date and time, and departure date and time
(2) If the guest’s current address is outside Japan: nationality, passport number, port of entry, and date of entry
(3) Any other information deemed necessary by the inn
Article 6: Guest’s Right to Cancel the Contract
1. Guests may cancel the accommodation contract by notifying the inn.
2. If a guest cancels all or part of the accommodation contract for reasons attributable to the guest, the inn shall charge a cancellation fee as set forth in Appendix 2.
3. If a guest fails to arrive on the day of check-in without prior notice, the inn may treat the accommodation contract as having been canceled by the guest. In such cases, any accommodation fees paid in advance shall be applied toward the cancellation fee.
Article 7: Guest Room Usage Hours
1. Guests may use the guest rooms from 3:00 PM until 11:00 AM the following morning. However, for consecutive stays, guests may use the rooms throughout the day, excluding the arrival and departure dates.
2. Except as permitted by the Inn, guests may not use the guest rooms outside the hours specified in the preceding paragraph. If such use is discovered, the Inn may charge a fee for the excess usage, depending on the circumstances.
Article 8: Compliance with Terms of Use
1. Guests and their companions (hereinafter collectively referred to as “Guests, etc.”) shall comply with the Inn’s Terms and Conditions of Accommodation while on the premises.
Article 9: Payment of Fees
1. The accommodation fees payable by the guest shall be determined in accordance with the contract.
2. Payment of the accommodation fees referred to in the preceding paragraph must be made in advance at the time of the guest’s reservation via credit card or an equivalent method.
3. Accommodation fees shall be charged even if the guest chooses not to stay after the inn has provided the guest with a room and made it available for use.
4. If it is discovered that the number of guests exceeds the number specified in the contract without prior notification, we will charge for the excess guests.
Article 10: Liability of the Inn
1. The Inn shall compensate the guest for any damages caused by the performance of the accommodation contract or any related contracts, or by the non-performance thereof. However, this shall not apply if such damages are not attributable to the Inn.
Article 11: Procedures When the Contracted Room Cannot Be Provided
1. If the Inn is unable to provide the guest with the contracted room, the Inn shall, with the guest’s consent, arrange for alternative accommodations under conditions as similar as possible.
2. If the Inn has made every effort to arrange alternative accommodations pursuant to the preceding paragraph but is unable to do so, the Inn and the guest shall consult to determine the appropriate course of action.
Article 12: Handling of Deposited Items
1. The Inn does not accept items for safekeeping. The Inn shall not be liable for any loss, damage, or other harm to items brought into the Inn by guests, except in cases of willful misconduct or negligence on the part of the Inn. Furthermore, the Inn does not accept the deposit of currency, securities, or other valuables under any circumstances. Consequently, the Inn shall not be liable for any damages resulting from the loss or damage of such valuables.
Article 13: Storage of Guests’ Luggage and Personal Belongings
1. This inn does not handle items left in storage. Furthermore, we do not accept luggage delivered in advance or through other means.
2. If a guest’s luggage or personal belongings are left behind at the inn after the guest has departed, and the owner is identified, the inn will, in principle, wait for the owner to contact us and seek their instructions. However, if the owner does not contact us or cannot be identified, the items will be held for seven days, including the day of discovery. After that period, valuables will be turned over to the nearest police station, and other items will be disposed of. However, food, beverages, tobacco, magazines, and any items that the inn deems difficult to store for hygiene reasons or that are deemed to be of no value will be disposed of immediately. Please note that we cannot provide any guarantee regarding items after they have been turned in to the police station. Guests shall not raise any objections to the decisions made under this section.
Article 14: Liability of Guests
1. If the Company incurs expenses for cleaning or repairing guest rooms, loses business opportunities, or suffers other damages due to acts by guests that violate these Terms and Conditions, or due to other causes attributable to guests as described below, the guest shall compensate the Company for the damages incurred.
(1) If damage to or theft of the property’s facilities or furnishings is discovered
(2) If special cleaning beyond the scope of normal use is required due to food or drink spills, vomiting, blood, bodily fluids, or other soiling
(3) If smoking is discovered within the property
(4) If costs are incurred for disposal or storage of items left behind;
2. If a guest or other person causes damage or injury to a third party by violating these Terms and Conditions of Accommodation or the Rules of Use set forth in Article 8, or if a guest or other person suffers damage or injury, the inn shall not be liable for any damages or other compensation.
Article 15: Use of Internet Communication
1. Guests shall use internet communication within this property at their own responsibility. The property shall not be liable for any damages incurred by guests due to service interruption caused by system failure or any other reason, except in cases of willful misconduct or gross negligence on the part of the property.
2. In the event that the property or a third party suffers or is likely to suffer damages due to inappropriate use of internet communication as determined by the property, the guest or accompanying persons shall be liable to compensate for such damages.
Article 16: Amendment of Terms and Conditions
1. These terms and conditions may be amended from time to time as necessary.
Article 17: Governing Law and Jurisdiction
1. Any disputes arising out of or in connection with accommodation contracts under these terms and conditions shall be subject to the exclusive jurisdiction of the Summary Court or District Court having jurisdiction over the location of this property as the court of first instance, and shall be governed by the laws of Japan.

Note
The percentages (%) represent the ratio of cancellation charges to the total accommodation charges for the entire reserved stay.
In the event that the number of reserved nights is reduced, cancellation charges shall be collected based on one day's stay (the first day), regardless of the number of nights reduced, in accordance with the applicable cancellation charge rate.
